Bare Metal Infrastructure Terms
These terms supplement the Silurian General Service Terms for each dedicated Bare Metal server ordered through Silurian.
1. Service and infrastructure supplier
Silurian sells, invoices, supports and manages the service shown in the order. The physical infrastructure is supplied by OVH HISPANO, S.L., calle Alcalá 21, 5ª, 28014 Madrid, Spain and may use other OVHcloud group companies for the selected datacenter. The Customer accepts the current OVHcloud contractual conditions incorporated for the infrastructure, including the applicable dedicated-server, acceptable-use, IP and data-processing terms.
2. Quote, stock and reviewed provisioning
The order records the Silurian server reference, location, options, net price, setup charge and billing interval. Stock and provider prices can change until a provider order is confirmed. Payment does not automatically purchase hardware: Silurian reviews the immutable order evidence, prepares the provider cart and submits it separately. If the exact configuration cannot be fulfilled, Silurian will not represent it as active and will offer an equivalent configuration, a new quote or the applicable cancellation and refund.
3. Access and administration
The handover states whether the service is unmanaged, managed or subject to a separate maintenance agreement. Unless the order says otherwise, the Customer is responsible for operating systems, applications, credentials, patching, firewall rules, user access, licences and workload configuration after administrative access is delivered. Silurian remains the first commercial and support contact for the infrastructure order.
4. IP addresses, network and location
IP addresses and network resources are licensed for use with the service and are not Customer property. They may be replaced, withdrawn, filtered, routed or transferred where technically or legally necessary. Geolocation databases and network routes can be inaccurate and are not a contractual guarantee of traffic origin or destination. Additional IP, bandwidth, private network and licence options follow the limits and charges shown in the order.
5. Abuse, security and compliance
The Customer must prevent and promptly remedy spam, malware, scanning, attacks, infringement, unlawful content, credential compromise and other abuse originating from or targeting the service. The Customer will maintain responsive security and abuse contacts and cooperate with reasonable evidence requests. Silurian or the infrastructure supplier may filter, isolate, suspend or terminate resources when required to contain risk, comply with law or provider policy, address non-payment or protect the network.
6. Backups and data
A dedicated server is not itself a backup. The Customer must maintain independent, tested copies of data it cannot afford to lose unless the order expressly includes a managed backup service with stated retention. RAID, snapshots, provider backup space and replacement hardware do not replace an independent recovery plan. The selected datacenter determines the primary infrastructure location; support, security and provider operations may process limited service data as described in the privacy and data-processing terms.
7. Availability, maintenance and hardware replacement
Internet paths, software and hardware can fail. Only the service level expressly identified in the order applies. Announced or emergency maintenance, attacks, Customer configuration, upstream networks and excluded events may not qualify for service credits. Hardware incidents are handled through diagnosis and repair or replacement; no uninterrupted or error-free service is promised.
8. Renewal, price changes and termination
The billing cycle, renewal setting and current price are shown in the order and account. Provider price changes, option changes or replacement configurations apply to a future renewal only after the notice or acceptance required by the agreement and applicable law. On suspension or termination, access and data may become unavailable quickly; the Customer must export data before the effective date. Unpaid charges, abuse response and legal preservation duties survive where applicable.
9. Separately priced installation
Where the order separately identifies an installation charge, installation is a distinct one-off service consisting of the actual preparation of the selected server for the Customer: allocation and configuration of the ordered hardware and network resources, installation or preparation of the ordered operating system where included, commissioning checks, and delivery of the agreed administrative access. Only work included in the order is charged. This charge is payable separately from the recurring server service, is disclosed before the order and is not a cancellation penalty or a charge merely for reserving stock, receiving payment or recording an order. No installation charge is retained when the order waives it or includes it at no additional price.
Before starting chargeable installation during the consumer withdrawal period, Silurian obtains a separate express request for that work and acknowledgement of the consequences of completion. Accepting these terms alone is insufficient. Installation is fully performed only when the agreed preparation is actually completed and the server access is made available to the Customer; Silurian retains the work and delivery evidence. Where the statutory conditions are met, the separately agreed installation price may be retained following withdrawal after complete installation. If the work is incomplete, only any proportionate amount lawfully due for work actually requested and performed may be charged. Without the required prior request or information, no installation amount is charged on consumer withdrawal. Non-performance, defective installation and other mandatory refund rights remain protected.
10. Consumer withdrawal and refunds
A consumer may withdraw from an eligible distance dedicated-server contract within 14 calendar days of its conclusion without giving a reason, by sending a clear statement through Workspace support or the published Silurian contact channel before the period expires. The statutory model form is optional. Silurian refunds the full recurring server-service amount paid, without deducting elapsed server use; any separately agreed installation amount is treated only under section 9. Refunds are made within 14 calendar days of receiving the notice through the original payment method unless otherwise expressly agreed without cost to the consumer. Withdrawal ends access to the server; export any data you need to retain.
After the applicable withdrawal period, cancellation or a decision not to use the server does not entitle the Customer to a voluntary refund of the committed or prepaid period and does not erase accrued charges. Any longer statutory withdrawal period, non-performance, lack of conformity, breach and other mandatory remedies remain unaffected. Purchases made for business or professional purposes do not receive the statutory consumer withdrawal right.
The framework is Articles 3, 97, 98.8, 102, 103(a), 104-108, including 108.4 and 108.5, of Spanish Royal Legislative Decree 1/2007, Articles 6, 8(8), 9-14 and 16(a) of Directive 2011/83/EU, as amended and implemented nationally, and the interpretation of separately priced, fully performed upfront services in Court of Justice judgment C-641/19, PE Digital. Spanish law does not deprive a consumer of mandatory protections applicable in their country of residence, including those preserved by Article 6 of Regulation (EC) No 593/2008 (Rome I). Other separately priced products have their own terms.
